Advice for a novice with a new board game idea?

The new product is actually a new board game. I've written a marketing plan and know how I'd like to get it to the market, my question is how do I protect myself? Although the design is unique I've been told by an attorney your can't get a patent for a design. So my thoughts are that if I put the game out on the market, that a large company can simply copy it or make minor changes to the design and simply name it something else. Can anyone give me any advice as to how I go about protecting my new idea?Advice for a novice with a new board game idea?

But basically... patents are for hardware, whilst copyright is for written/creative works (including drawings, paintings, photos, stories, song lyrics, music, poetry, computer programs, etc.





In the case of a board game... I suppose you would copyright the rules of the game, the logos and characters and other artwork involved, etc. Make sure you have something distinctive first, or it won't count. For example, if you just invent chess with a different piece, that probably wouldn't be considered innovative enough to warrant protection under the law. Similarly, if you ';invent'; something, but someone else had already invented it and you just didn't know, you don't have any rights there.





p.s.: Your attorney sucks, if he didn't at least mention copyright and its differences with patents. I'm an interested layperson, and I could go a lot further than simply telling you that ';you can't get a patent for a design.'; :/Advice for a novice with a new board game idea?
